Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Checkpoint website, CLI tools, browser extensions, and related services (collectively, the "Service") provided by Checkpoint Labs, LLC ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


2. Accounts

Registration

You must create an account to use most features of the Service. You agree to provide accurate, current information and to keep it updated. You may register using a third-party authentication provider (e.g., Google, GitHub).

Security

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@checkpoint.build if you suspect unauthorized access.

Termination

You may delete your account at any time through the Service settings. We may suspend or terminate your account if you violate these Terms or if required by law.


3. Use of the Service

Permitted Use

The Service is designed to help developers and teams share local development environments, collect visual feedback, and manage projects. You may use the Service for lawful purposes consistent with these Terms.

Restrictions

You agree not to:

  • Use the Service for any illegal purpose or in violation of applicable laws
  • Share, transmit, or make accessible through tunnels any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to build a competing product or service
  • Resell, sublicense, or redistribute access to the Service without our prior written consent
  • Use automated means to access the Service except through our published APIs and CLI
  • Circumvent any rate limits, access controls, or security measures

4. Tunnels

How Tunnels Work

The Service creates secure tunnels that expose your local development server to a public URL for review purposes. Traffic passes through our infrastructure but is not stored, inspected, or logged by us (except for connection metadata such as timestamps and status).

Your Responsibility

You are solely responsible for the content served through your tunnels. You must ensure that any content accessible via a tunnel complies with applicable laws and these Terms. Do not use tunnels to serve production traffic, host persistent websites, or distribute malicious content.

Availability

Tunnels are provided on a best-effort basis. We do not guarantee uptime, latency, or availability. Tunnels may be terminated without notice if they violate these Terms or if necessary for maintenance or security.


5. Comments & Collaboration

Comments and feedback left on tunnels are stored by the Service and visible to tunnel participants based on sharing and permission settings. You retain ownership of the content you submit but grant us a limited license to store, display, and transmit it as necessary to provide the Service.

You are responsible for the content of your comments. Do not post content that is illegal, abusive, or infringes on the rights of others.


6. Third-Party Integrations

The Service allows you to connect third-party services (e.g., GitHub, Linear, Jira, Slack). These integrations are governed by the respective third party's terms of service and privacy policy. We are not responsible for the availability, accuracy, or practices of third-party services.

When you authorize an integration, you grant us permission to exchange data with that service on your behalf as necessary to provide the integration functionality.


7. Intellectual Property

Our IP

The Service, including its design, code, documentation, trademarks, and logos, is owned by Checkpoint Labs, LLC and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

Your Content

You retain ownership of all content you create, upload, or submit through the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display Your Content solely as necessary to provide and improve the Service.

Feedback

If you provide suggestions, ideas, or feedback about the Service, we may use them without obligation or compensation to you.


8. Payment & Billing

Paid Plans

Certain features of the Service may require a paid subscription. Pricing, billing cycles, and payment terms are described on our website. All fees are non-refundable except as required by law or as explicitly stated.

Payment Processing

Payments are processed by Stripe. By providing payment information, you agree to Stripe's terms of service. We do not store your full payment card details.

Changes to Pricing

We may change pricing with at least 30 days' notice. Continued use of paid features after a price change constitutes acceptance of the new pricing.


9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of any information provided through the Service.


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECKPOINT LABS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.


11. Indemnification

You agree to indemnify and hold harmless Checkpoint Labs, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content served through your tunnels.


12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.


13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where practicable, by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.


14. General

  • Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Checkpoint Labs, LLC regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
